Rule 27
Management of emergency health services

(1) For immediate management of health services in case of emergency under sub-section (1) of section 48 of the Act: The Ministry shall mobilize rapid response teams and emergency medical teams.
(2) The work, duties, rights and procedures of the rapid response team and emergency medical group as per sub-rule (1) shall be as determined by the Ministry.
(3) For emergency treatment, government, non-government, private, cooperative, non-profit community, teaching hospitals and other health institutions should arrange adequate infrastructure and facilities in their organizations to provide emergency health services.
(4) If a disaster situation is created due to an epidemic of an infectious disease, pest, micro-organism, accidental or unexpected cause, according to subsection (4) of section 48 of the Act, the Government of Nepal, the relevant provincial government and the local level may issue necessary orders and declare a public health emergency.
(5) If a public health emergency is declared in accordance with sub-rule (4), the Government of Nepal, the provincial government or the local level may, at any time, issue necessary instructions to the non-governmental, private, cooperative, non-profit community teaching hospital or other health institutions, to operate, and from such health institutions. He can make services available, mobilize health workers working in health institutions or take control of such health institutions and operate them.
(6) According to sub-rule (5): If a health institution is taken under control, the operation of such health institution will be as determined by the relevant government level declaring a public health emergency in accordance with sub-rule (4).
(7) According to this rule, to manage emergency health services or in the event of a public health disaster, the relevant government or level may assign health workers working in any health institution to health institutions or areas as needed.
(8) If a state government or a local level declares a public health emergency in accordance with sub-rule (4), then QIf there are not enough health workers available in the country or at the local level, the local level will work with the state and Nepal government and the state government. The Government of Nepal can request more health workers and if there is such a demand, the Government of Nepal and the provincial government will deploy the manpower working under them to such public health disaster areas.
(9) Notwithstanding anything written elsewhere in this rule, if the situation as per sub-rule (4) does not exist, the Government of Nepal, the provincial government or the local level may issue the necessary order and withdraw such declaration of public health emergency at any time.
